Ted has several decades of experience representing clients in complex litigation and multi-case product liability actions. He provides pre-trial support and develops discovery litigation and pre-litigation strategies, including developing eDiscovery playbooks, for corporate entities. His counsel also extends to providing guidance on compliance with federal and state civil discovery rules, including amendments to procedural and evidentiary rules.
In collaboration with Redgrave technical and business advisors, Ted analyzes emerging digital applications to counsel clients on associated retention and legal hold issues, and provides guidance on legal hold procedures and document retention policies and best practices. Ted has extensive experience managing discovery in multi-case litigation matters and developing processes and procedures to maximize efficiency and consistency.
Ted also has many years of experience providing advice and strategy regarding assertion of attorney-client privilege and work product claims, including preparing privilege logs and defending challenges to privilege claims. Ted was part of the Redgrave team that prepared an amicus brief in the United States Supreme Court on behalf of Lawyers for Civil Justice concerning the circumstances under which communications involving both legal and non-legal advice are protected by attorney-client privilege.
Ted is a founding member of The Sedona Conference® Working Group on Electronic Document Retention and Production (WG1) and the Cleveland Electronic Discovery Roundtable, and he has contributed significantly to developing best practice recommendations and principles for electronic document production. He has also notably contributed to the chapter “Discovery of Electronically Stored Information” in the treatise Business and Commercial Litigation in Federal Courts and has authored or co-authored several articles regarding the attorney-client privilege and eDiscovery. Ted has also served as a faculty member and panelist for continuing legal education courses offered by The Sedona Conference®, the CSU College of Law, and the Cleveland Metropolitan Bar Association, covering topics including eDiscovery, Amendments to the Federal Rules of Civil Procedure, and privilege issues.
Prior to joining Redgrave, Ted practiced law at Jones Day and was a founding member of that firm’s electronic discovery committee.
Ted’s work experience includes:
- Drafting amicus briefs on behalf of an advocacy organization to the U.S. Supreme Court, the U.S. Court of Appeals for the Sixth Circuit, and the Delaware Chancery Court regarding the corporate attorney-client privilege and issues pertaining to the use and preservation of ephemeral messages
- Preparing proposals for amendments and comments regarding proposed amendments to the Federal Rules of Civil Procedure on behalf of an advocacy organization
- Developing and managing discovery strategies for a major automobile company and consumer products companies in multi-case, multi-jurisdictional, consolidated, and class actions with related federal grand jury investigations
- Defending attorney-client privilege and work product claims made by several major corporations in complex multi-case and multi-jurisdictional litigation and investigations
- Preparation of discovery guidance for case counsel for a telecommunications company
- Devising creative solutions for electronically stored information (ESI) discovery and preservation issues that are legally defensible and cost-effective for major U.S. and international corporations
- Advising corporate clients concerning the protection of attorney-client privileged communications
- Preparing comprehensive privilege guidance memorandum for use in privilege reviews for corporate clients
